Terms of Service
This is a courtesy English translation. The binding version is the German AGB.
1. Scope
These Terms of Service govern all contracts between Pixelsplit Games GmbH (registered seat: Alfred-Herrhausen-Allee 3-5, 65760 Eschborn; "Provider") and its customers regarding use of the services offered under CritMap. They apply equally to consumers (§ 13 BGB) and businesses (§ 14 BGB) unless otherwise stated.
2. Conclusion of contract
Display of services on the website does not constitute a binding offer. Creating a user account establishes a free-of-charge usage contract. Analyses are generated on your express request.
The Provider also offers paid subscriptions (see § 5). A paid contract is concluded when you select a subscription, are forwarded to the checkout operated by our payment service provider Stripe, and complete the order there by clicking the order button. The information duties for electronic commerce under § 312i and, for consumers, § 312j BGB are honored in this checkout: it provides means to identify and correct input errors before submitting the order, states the language available for the contract (German; English as a courtesy), presents the essential order details and the total price before the binding order button, and an order-confirmation email is sent after the order is placed.
3. Description of services
The Provider offers AI-assisted SWOT analyses based on publicly available Steam reviews. Analyses are not a substitute for professional market research; no warranty is given as to the factual accuracy of AI output.
Public display by default. By default, the analyses you generate may be displayed publicly in the CritMap homepage showcase (without identifying you). On paid plans (Indie and above) you can disable this for all of your analyses via the "Private research" setting. The Provider may curate which analyses appear and remove any analysis from the showcase at its discretion.
Steam / Valve disclaimer. Steam® and Valve® are registered trademarks of Valve Corporation. CritMap is not affiliated with, sponsored by, or endorsed by Valve. Review data is obtained via the public Steam Web API and remains the property of its respective authors and/or Valve Corporation; analyses generated by CritMap are independent AI summaries, not Valve content.
4. User obligations
- Use the service lawfully.
- Do not abuse the API beyond the explicitly published rate limits.
- Do not attempt to reverse-engineer prompts or models.
- Keep account credentials secure.
5. Prices and payment
The Provider offers paid subscription plans. The currently offered plans and their list prices are:
- Indie: €15 per month or €150 per year.
- Studio: €39 per month or €390 per year.
- Publisher: €99 per month or €990 per year.
The prices and plans currently on offer are always shown on the pricing page, which is authoritative for the current offering. Subscriptions are billed in advance for the chosen billing interval (monthly or yearly). Payment is processed by our payment service provider Stripe (see § 8 Data protection and the Privacy Policy); the Provider does not receive or store your full card data.
The list prices shown above and on the pricing page are final prices including the applicable statutory value-added tax (VAT) for consumers. For customers in certain non-EU jurisdictions (for example the United States and Canada), any applicable sales or similar tax is added on top during checkout. The total amount payable is displayed in the Stripe checkout before you place a binding order.
6. Consumer right of withdrawal
Consumers have a fourteen-day right of withdrawal under § 312g in conjunction with § 355 BGB for paid subscriptions. The following applies:
Withdrawal instructions
Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of conclusion of the contract. To exercise the right of withdrawal, you must inform us (Pixelsplit Games GmbH, Alfred-Herrhausen-Allee 3-5, 65760 Eschborn, email: [email protected]) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal. If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
Because we do not yet obtain the consumer's express consent to begin performance before the end of the withdrawal period together with the acknowledgement of the resulting lapse of the right of withdrawal (§ 356 (4) and (5) BGB), the right of withdrawal is not curtailed: the unrestricted fourteen-day right of withdrawal applies, and amounts paid for the period already supplied are reimbursed in accordance with the statutory rules.
7. Liability
- The Provider is liable without limitation for intent and gross negligence; the same applies to its legal representatives and vicarious agents.
- Liability for injury to life, body, or health is unlimited even for slight negligence (§ 309 No. 7a BGB; mandatory liability floor).
- Liability under the Product Liability Act (ProdHaftG) remains unaffected.
- In case of slight negligence, liability is limited to breach of cardinal contractual obligations and capped at typical foreseeable damage.
- Liability is otherwise excluded.
8. Data protection
Processing of personal data is governed by the Privacy Policy.
9. Term and termination
Paid subscriptions renew automatically for the chosen billing period (monthly or yearly) unless terminated by the end of the current period. Termination is possible at any time without giving a reason and takes effect at the end of the current billing cycle. You can manage and cancel your subscription through the Stripe customer portal, which is reachable while signed in at Dashboard → Billing (/dashboard/billing); a cancellation there ends the subscription at the end of the paid period.
We are working to provide cancellation in the form required by § 312k BGB. If the route above does not yet meet those requirements in full, you may also terminate by an unequivocal statement to the contact details in § 6, and we will give effect to your cancellation.
10. Changes to these Terms
The Provider may change these Terms with a six-week notice period where a reasonable ground exists (e.g. changes in law, supreme-court rulings, or technical framework conditions). You will be informed in text form and may object within the six-week window; in case of objection, you have an extraordinary right of termination.
Price changes and material scope changes require your express consent; tacit / fictive consent is expressly excluded (BGH XI ZR 234/20, 2021-04-27).
11. Miscellaneous
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the consumer's habitual residence remain unaffected (Art. 6 Rome-I Regulation). Place of jurisdiction for merchants within the meaning of § 38 ZPO is Frankfurt am Main; for consumers, statutory jurisdictional rules apply.
Language. These Terms exist in German and English. For consumers habitually resident in Germany, only the German version is binding. For consumers outside Germany, the binding language follows Art. 6 Rome-I Regulation and the language in which the contract was concluded.
Severability. Should any provision of these Terms be invalid or become invalid, the validity of the remaining provisions shall remain unaffected.
12. Consumer dispute resolution pursuant to § 36 VSBG
Die Pixelsplit Games GmbH ist nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
